About IP Tribunal
- The Ethiopian Intellectual Property Tribunal (IPT) was established to ensure effective legal protection and fair adjudication of intellectual property rights in Ethiopia. In accordance with Article 5(1) of Proclamation No. 320/1995, the Intellectual Property Authority was created to promote the protection and utilization of intellectual property. To support this mandate, a transparent and efficient system for appeals and dispute resolution was deemed essential. Consequently, the IPT was formally established under Directive No. 642/2013 to oversee these matters. The IPT operates under the authority granted by Article 44(1) of the Copyright and Neighboring Rights Protection (Amendment) Proclamation No. 872/2014 and the Federal Supreme Court Cassation Decision No.71216. It is empowered to hear, adjudicate, and determine civil cases arising in connection with intellectual property rights, excluding cases related to extra-contractual liability.
Who can File a Complaint
- Any individual, business, or organization that believes their intellectual property (IP) rights have been violated, or wishes to appeal a decision made by the Ethiopian Intellectual Property Authority (EIPA), may submit a formal complaint to the Intellectual Property Tribunal. To initiate the process, the complainant must submit a written complaint in accordance with the Tribunal’s procedural requirements. Note: Legal representation by an accredited intellectual property practitioner or attorney is not mandatory but is strongly recommended.
